Court Opinions

Decisions of the Delaware courts are reported in the Atlantic Reporter and can be found on Lexis and Westlaw. Unreported and slip opinions of the Delaware Supreme, Chancery and Superior courts from 2001 on, are available on the courts' website.

The law library has an incomplete set of earlier unreported opinions in paper, these are shelved in the Treatise section of the library. Coverage varies, but is generally from 1975 to 2003.

Family Court opinions are not available online from the Court and we stopped receiving them in paper in 2014. 1972-2011 decisions are in the Treatise section at KFD94.5 .A514, 2012-2014 decisions are on Reserve. Some Family Court opinions are on Lexis and Westlaw.

If we do not have a copy of an opinion you will have to contact the appropriate court.

 

Practice Manuals

Delaware Appellate Handbook, 2nd ed. KFD555 .D4 1996 For use by Delaware attorneys in appellate practice before the Delaware courts in conjunction with the applicable rules of court and provisions of the Delaware Code. Available online from the Supreme Court's website

Finger, David L. & Louis J. Finger. Delaware Trial Handbook. KFD538 .F55 1994 One volume treatise providing the Delaware attorney with a guide to courtroom practice and procedure. No longer updated in paper. But the author has an updated online edition available free on his firm's website.

Wolfe, Donald J., Jr., and Michael A. Pittenger. Corporate and Commercial Practice in the Delaware Court of Chancery. KFD531 .W65 2000 Description of creation and development of Delaware’s Chancery Court into one of the few remaining courts of equity in the United States. The authors provide a comprehensive examination of litigation procedures and substantive doctrines that they regard as most central to litigation of corporate and commercial disputes before the Delaware Court of Chancery.

Woolley, Victor B. Practice in Civil Actions and Proceedings in the Law Courts of the State of Delaware. Star Print. Co., 1906. KFD530 .W6 1906 Yes, this classic treatise is still used in Delaware. It's been cited in three Delaware opinions so far in 2016. Delaware Law Library has several copies of the original and a reprint edition published by Gaunt in 1985. It's also been scanned by Google Books: Volume One - Volume Two.

 

Court Rules

All Delaware Court rules are available on the state Courts' website.

Delaware Rules Annotated. KFD30.5 .M5 A7 Issued as part of the Delaware Code Annotated, these volumes provide an annotated version of all Delaware Court Rules. Some forms are provided.

Delaware Truth in Sentencing Benchbook. Designed to assist sentencing judges, prosecutors, and defense attorneys in creating sentences consistent with the goals of sentencing reform promulgated by the Delaware Sentencing Accountability Commission. The law library has some older editions in our archives.
